Author Lucien Khodeir Releases Second Book Critical of Canada’s Child-Support Guidelines

Read about a newly released book, titled “ultra vires,” that argues that the child-support formula in Canada’s child-support guidelines operates outside its alleged authority.

Toronto, Canada, May 16, 2009 --(PR.com)-- “Subsection 26.1(2) of the Divorce Act, R.S.C. 1985, c. 3 (2nd Supp.), lays out the mandatory principle under which a regulation of the Divorce Act, namely the Federal Child Support Guidelines, SOR/97-175, is to be constructed,” says Lucien Khodeir, author of “ultra vires,” a second self-published book by that author critical of Canada’s child-support guidelines. Mr. Khodeir reads that principle: “The guidelines shall be based on the principle that spouses have a joint financial obligation to maintain the children of the marriage in accordance with their relative abilities to contribute to the performance of that obligation.”

The title of the new book is a common phrase in legal circles and means “outside the authority” in Latin. Mr. Khodeir says: “Since the definition of the child-support formula is suppressed in the Federal Child Support Guidelines, anyone wanting to critically analyze the formula must read a technical report published by the Department of Justice Canada in December 1997. That critical analysis, performed in the book, leads to the inescapable conclusion that the child-support formula and the resulting child-support tables operate outside the authority of subsection 26.1(2) of the Divorce Act.”

"ultra vires" is marketed as a useful tool to any Canadian family-law lawyer who intends to question in a legal argument the authority of the child-support formula/tables of the Federal Child Support Guidelines.
