FTC Revises Procedures Notes Picking Perfection by Pcdata USA

East Granby, CO, April 26, 2015 --(PR.com)-- Brent Kendall, reporter for the Wall Street Journal said, that amid growing pressure from congressional Republicans, the Federal Trade Commission is revising procedures for challenging mergers it believes are anticompetitive, a move that could factor into its pending case against the deal that would combine Sysco Corp. and US Foods Inc. At issue is the interplay between two different venues for legal proceedings that can take place when the FTC sues to block a merger.

Under new rules, if the FTC doesn't win an injunction from a federal judge it will suspend in-house trial proceedings upon request by the merging entities, a change that could benefit companies that beat the FTC in the initial federal court hearing. The shift doesn't force the FTC to abandon its case, but it could make it harder for the agency to continue with its challenge if it loses in federal court. This portends more mergers in these sectors and the need for standardized distribution center, warehousing, and manufacturing picking solutions is vital to lean production practices.
