In fact, in New York, the conduct must rise to the level of “outrageous or extreme” in order for a court to grant money damages. “While all instances of insults or name-calling will not give rise to a meritorious lawsuit,” Hornberger said. “Former spouses should do their best to keep the impulse to lash out in check.” A person who brings this type of lawsuit will need to show a pattern of behavior that actually caused severe physical or psychological harm.
