Event Synopsis:

The Omnibus Rule issued in 2013 by the Department of Health and Human Services (HHS) under the Health Insurance Portability and Accountability Act (HIPAA) and the Health Information Technology for Economic and Clinical Health (HITECH) Act enhances the liability risks to all HIPAA covered entities (health care providers, health care plans, and health care clearinghouses) and their “business associates” (professional service providers, data management vendors, data analytics firms, etc.) of potential unauthorized uses or disclosures of personal (“protected”) health information (PHI). A core goal underlying both HIPAA and the HITECH Act was to enhance the flow of electronic health information and thereby increase the accuracy, reliability and accessibility of patient records and reduce the costs of the health care system attendant to exchanging medical records for purposes of treatment and payment. Achieving these goals, however, entails new privacy and security risks, and the rapid development of health information technology (HIT) poses an additional, ongoing challenge to mitigate such risks.

This webinar will address these challenges from a legal and practical perspective, providing background on key aspects of the 2013 Omnibus Rule; information on HHS’s anticipated additional regulations implementing the HITECH Act; aggressive regulatory and enforcement actions by other authorities, including the Federal Trade Commission, in the area of health information privacy and security; and practical, concrete guidance on how to design, employ, and manage health information technologies to anticipate and mitigate risk.
