Many banks have recently been experiencing tough and thorough safety and soundness exams while at the same time trying to cope with all the credit problems associated with a general economic downturn. Safety and soundness examiners are carefully reviewing commercial and residential real estate loans and in some cases, are demanding write downs and reclassifications of these types of loans particularly where there are no recent appraisals to support the value of the collateral. Examiners are also looking closely at brokered deposits and Federal Home Loan Bank advances and are being critical of high commercial real estate concentrations.

About Maureen A. Young

Maureen A. Young is a partner with Bingham McCutchen LLP, where she is a member of the Financial Institutions Corporate and Regulatory Group and the Commercial Technology Group and co-chair of Bingham’s Privacy and Security Group. Her practice focuses on corporate and regulatory matters involving financial institutions, including mergers, acquisitions, restructurings, technology and outsourcing deals, and other transactional matters; compliance and enforcement actions; charter strategy and regulatory approvals; and advice with new product offerings. She is an expert in USA Patriot Act/Bank Secrecy Act compliance matters, and regularly advises on transactions with affiliates, Regulation E, Fair Credit Reporting Act, OFAC, and Foreign Corrupt Practices Act issues, among other regulatory areas. She also regularly advises on compliance with federal and state privacy and data protection laws, e-commerce and cyberlaw issues, and is a frequent lecturer on privacy, information security, data protection and vendor management practices.

Ms. Young received her AB degree from Georgetown University and her MA, PhD and JD degrees from the University of California at Berkeley. Ms. Young has served as chair of numerous banking and professional associations and is active with the California Bankers Association. She is currently an advisory member of the California State Bar Financial Institutions Committee and California State Bar Cyberspace Committee; Chair of the Financial Holding Company Subcommittee of the ABA Banking Law Committee; and a member of the BASF’s Corporate Law Department Executive Committee, among other professional affiliations.
