)-- The Economic Stimulus Act of 2008 rekindled the somewhat complex concept of “bonus depreciation” (50% 1st year) for select new “qualified” properties which were put into service before 09. The key issued addressed in this revenue procedure are: what is eligible as qualified property? & what are the computational aspects?
Follow up Revenue Procedure 2009-16 Aims to address certain issues not covered in 2008-65. Some of the key issues it addresses are: how you make the election? And how do you determine which rules apply as there are different rules for different governing elections in different fiscal calendar years. Another key issue is control groups making the election and how they make go about computing and allocating the election. And finally what about reporting to partnerships & effect of election on S corporations?
