Foreign Corrupt Practices Act ("FCPA") enforcement actions continue to be high priorities for the US Department of Justice ("DOJ") and US Securities and Exchange Commission ("SEC"). Recent settlements emphasize the ongoing need for comprehensive and effective anti-corruption compliance programs, particularly relating to the retention and monitoring of third party agents, proper documentation of expenses and claims, and interacting with government officials. This session will provide critical insight regarding:

- Tools and best practices for preventing and identifying FCPA risks and potential violations of law;
- Practical steps for minimizing third party agent risk;
- Lessons learned from recent FCPA enforcement actions; and

About Mitchell S. Ettinger

Mitchell S. Ettinger is co-chair of Skadden’s international Government Enforcement Litigation Group and a member of the Criminal and Civil Litigation practice of the firm’s Washington, D.C. office. For more than 20 years, he has represented corporations and individuals in connection with federal and state grand jury investigations, complex civil litigation and matters before administrative agencies, including the Securities and Exchange Commission.

Mr. Ettinger has been involved in many high-profile matters, including successfully defending Robert A. Altman in a jury trial arising from criminal charges brought by the Manhattan District Attorney’s Office in connection with the Bank of Credit and Commerce International affair and serving as an integral member of the defense team that represented President Clinton in connection with the sexual harassment lawsuit brought by Paula Jones.
Mr. Ettinger’s scientific educational background has enabled him to develop particular expertise in False Claims Act and qui tam actions.

Mr. Ettinger also conducts internal investigations for the purpose of defending against criminal allegations, Securities and Exchange Commission investigations, and suspension and debarment proceedings. He has particular experience in areas involving the Foreign Corrupt Practices Act, health care fraud, procurement fraud and alleged violations of federal and state conflict of interest provisions, in matters involving simultaneous criminal, civil, administrative and congressional proceedings. Mr. Ettinger was selected for inclusion in The Best Lawyers in America 2010. He lectures on False Claims Act and FCPA issues, corporate compliance best practices, and white-collar defense techniques.
