Event Synopsis:

During the 1990s, the Internet became a major source of products and services for adults and children; by 1998, approximately 10 million US children were using the Internet. The design of web browsers enabled the collection of information about Internet users and un-scrupulous marketing to children and the collection of their personal information led to calls for legislation.

The Children’s Online Privacy Protection Act of 2000 (COPPA) protects the privacy of children under the age of 13 by requesting parental consent for the collection or use of any personal information of children through a company website. It requires a website operator to determine the age of users under 13, obtain verifiable parental consent a priori, and to post a clear and detailed privacy policy describing the information collected from children and its potential use.

Critics claim that the FTC’s verification methods – facsimile and mailing of signed forms, credit card numbers, or forwarding digital signatures by e-mail – are too in-adequate, slow, costly, and cumbersome. In addition, children may circumvent the restrictions, and the process exposes parents to risk of credit card fraud. Some sites must comply despite not selling to children (e.g., Amazon.com). First Amendment issues of the right to communicate anonymously also come into consideration. Recently, the FTC has not adequately enforced COPPA or has failed to act promptly.
