Unless advised properly, closing a Chapter 11 case on a cost-effective basis can be problematic. Resolving certain claims and interests in a Chapter 11 case is time consuming and will often utilize any funds that are set aside for creditors. To aid this dilemma, and to enable a debtor to emerge from bankruptcy sooner than would be possible, popular tools such as post-confirmation liquidation and litigation trusts are used, as well as a structured dismissal.
