About Patrick F. Sullivan

Patrick F. Sullivan is an associate attorney focusing his practice in products liability and malpractice defense, including medical device, long term care, pharmaceutical, professional malpractice, and toxic tort litigation. He represents professionals and companies in complex tort litigation regarding their medically and scientifically intricate and unique procedures and products. He has extensive experience in all stages of litigation including drafting and arguing motions, deposing witnesses, and defending client interests in both pre-trial and trial litigation. Prior to joining Segal McCambridge, he worked as an insurance defense attorney in Chicago.

Mr. Sullivan earned his J.D. from The John Marshall Law School where he received Dean's List honors and a Distinguished Scholarship. He is licensed to practice in Illinois and is admitted to the Federal Bar for the Northern District of Illinois and the Western District of Wisconsin.

About Martha E. Drouet

Martha E. Drouet is an associate attorney focusing her practice on toxic tort, product liability and complex commercial litigation. As a member of the national coordinating counsel team for a products manufacturer, Ms. Drouet monitors litigation in high-indemnity jurisdictions. She has extensive experience in managing hundreds of cases independently from pre-litigation through trial including cases in areas such as transportation, environmental regulation, premises liability, medical malpractice and catastrophic injuries.

Ms. Drouet earned her J.D. from Chicago-Kent College of Law with a certificate in Environmental and Energy Law. While a student at Chicago-Kent, she was a competitor and coach for the National Environmental Law Moot Court Competition team and received a CALI award for the highest grade in Environmental Law Clinic. She served as executive articles editor for the Journal for Environmental and Energy Law and as secretary for the Kent Justice Foundation.

Abstract

Several decades after the start of prescription of Opioids in the late 1990s, the Opioids Crisis has become extremely rampant. This short-term relief created long-term after-effects with the alarming number of victims and thousands of filed lawsuits. Unjust enrichment and engaging in fraudulent and negligent conduct have been the common complaint of plaintiffs. However, due to the robust defenses from the targets of these lawsuits, various insurance coverage issues also emerged.

As plaintiffs continue to seek compensatory and punitive damages, as well as statutory penalties and costs, courts are yet to have an opportunity to review the scope of an insurer's duty. Hence, insurance practitioners will continue to find cases on whether insurance policies provide coverage for these claims.
