Under apportionment, patent damages “must reflect the value attributable to the infringing features of the product, and no more.” In this way, the value of an infringing product’s unpatented features prevents the patent owner from unfairly collecting a royalty.
As the complexity of requirements in the patent litigation landscape continues to intensify, the need to be updated with the new developments and best practices remains crucial for patent owners and counsel.
Join a panel of key thought leaders and professionals assembled by The Knowledge Group as they delve into an in-depth analysis of the current trends and recent court rulings involving Apportionment and the EMVR.
