About Berkeley Research Group

Berkeley Research Group, LLC (BRG) is a global consulting firm that helps leading organizations advance in three key areas: disputes and investigations, corporate finance, and strategy and operations. BRG is headquartered in Emeryville, California, with offices across the United States and in Asia, Australia, Canada, Latin America, the Middle East, and the United Kingdom.

Abstract

Under apportionment, patent damages “must reflect the value attributable to the infringing features of the product, and no more.” In this way, the value of an infringing product’s unpatented features prevents the patent owner from unfairly collecting a royalty.

As the complexity of requirements in the patent litigation landscape continues to intensify, the need to be updated with the new developments and best practices remains crucial for patent owners and counsel.

Join a panel of key thought leaders and professionals assembled by The Knowledge Group as they delve into an in-depth analysis of the current trends and recent court rulings involving Apportionment and the EMVR. Speakers will also provide the audience with practical strategies in bringing out the best in these lawsuits in a rapidly evolving legal climate.

Some of the major topics that will be covered in this course are:

1. Addressing the use of comparable licenses in apportionment - technological and economic comparability
2. Overview of Daubert exclusions to damages experts on comparability of licenses
3. Explanation through caselaw (Daubert exclusion) of use of broad comparisons from third party sources
3. Discussion of a recent Daubert exclusion of the use of jury verdict as a comparable transaction and the effect of the exclusion on other Daubert challenges
