About Hon. John M. Facciola

John M. Facciola is a retired United States Magistrate Judge who formerly served in the United States District Court for the District of Columbia. He authored over 700 opinions, many of them in e-discovery and in the impact of information technology upon Fourth Amendment principles, and a recipient of the Sedona Conference's Lifetime Achievement Award. He is an Adjunct Professor Law at Georgetown Law where he teaches Information Technology and Modern Litigation, Evidence, Contracts and Constitutional Law.

Event Synopsis:

The amendments to the Federal Rules of Civil Procedure, which took effect on December 1, 2015, represent the most sweeping changes to the Federal Rules in years and directly impact all aspects of e-Discovery. These changes influence the fundamentals of litigation, such as the scope of discovery itself and the specificity required in objections to discovery requests. Additionally, the Rules now provide a framework for evaluating whether spoliation exists and the sanctions available to remedy the loss of electronically stored information.

Are you prepared for the FRCP amendments and how your e-Discovery strategy should change? Can you explain the differences to your client and offer practical advice on steps to take to prepare for litigation? If you are in-house, do you understand how the amendments might impact decisions about records retention or litigation budgets?

In this two-hour live webcast, Judge Facciola, Wendy Butler Curtis (eDiscovery of Counsel at Orrick), and Jennifer Brennan (Director at iDiscovery Solutions) will provide practical guidance about the FRCP amendments and their impact on e-Discovery. This session will include:

Overview of the changes to Rules 26, 34 and 37
Anticipated points of contention under the new Rules
Tips to comply with the heightened requirements for discovery objections and prepare for “early” discovery
Live interactive Q&A
