Event Synopsis:
On December 31, 2015, the Department of the Treasury's Office of Foreign Assets Control (OFAC) released its final regulations implementing Executive Order 13694, creating a new cyber sanctions program. The final rule authorized the Secretary of the Treasury to include two categories of individuals or entities in the Specially Designated Nationals List (SDN List). OFAC's new cyber-related sanctions allow Treasury to designate individuals or entities involved in “malicious cyber-enabled activities” that pose a “significant threat” to U.S. national security, foreign policy and economy.

The final rule and the inclusion of two new categories of individuals and entities in the SDN List require U.S. businesses to calibrate their compliance practices for existing U.S. sanctions regimes with this unique activity-based sanctions program. Although OFAC has yet to designate any person or entity under this regime, individuals and companies, particularly those in the technology and defense sectors, must be aware of the potential liabilities that could arise if their actions allow or contribute to activity covered by these sanctions. For U.S. companies in particular, the cyber-related sanctions create exposure from facilitation charges.
