Implementing the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 or Inflation Adjustment Act, the US Departments of Justice (DOJ), Labor (DOL) and Homeland Security (DHS) have made a significant increase in civil fines for immigration-related offenses committed by employers. The new penalties, which went into effect last August 1, 2016, are applicable to violations occurring after November 2, 2015. The largest increase in fines involves Form I-9 violations, from $110 – $1,100 per violation to $216 – $2,156.

The increased fines only demonstrate the government's continued efforts on enforcing federal immigration laws. To avoid steep financial liability, employers should ensure that they have a comprehensive Form I-9 compliance policy in place. It is also wise to periodically conduct an internal audit to remediate errors and lessen the severity of the Form I-9 violation fine.
