About Alexander J. Hadjis

Alexander J. Hadjis is a patent trial attorney. He is the Chair of Cadwalader’s International Trade Commission (ITC) Patent Litigation Practice and the Co-Chair of the firm’s Technology Industry Practice Group.

Mr. Hadjis represents clients as lead trial counsel before the federal district courts and the ITC. He has tried more than ten patent cases and litigated dozens over the course of his twenty year career.

Prior to joining private practice, Mr. Hadjis clerked for the Honorable Wilson Cowen of the U.S. Court of Appeals for the Federal Circuit. He received his J.D. from The University of Pittsburgh School of Law, an LL.M. from George Washington University Law School, and a B.S.E.E. from The Ohio State University.

Event Synopsis:

Over the last 10 years, the number of patent infringement disputes filed with the U.S. International Trade Commission (ITC) has increased dramatically. Cases at the ITC usually involve tele-communication devices, but also include a wide range of medical devices. The cases involving medical devices suggest that manufacturers and importers should monitor and address any issues that place them at risk of litigation relating to Section 337 of the Tariff Act of 1930. The Act allows U.S. intellectual property owners to seek exclusion orders barring the importation of infringing devices into the United States.

Medical device cases focus almost exclusively on patent infringement, but may include other unfair acts. Remedy under Section 337 is prospective. Uniquely there is a ‘domestic industry requirement’ in which the manufacturer must show significant US investment in production, research, development, engineering, and licensing of a device. Careful planning for Section 337 issues by complainants and quick decisions by respondents are required to ensure a favorable out-come and reduce the risk of litigation. Public interest issues are of particular concern for medical devices. In a two hour live webcast, a panel of thought leaders and practitioners assembled by The Knowledge Group will discuss the Intellectual Property Infringement of Medical Devices and Litigation Trends and Practices of the US ITC in 2015.
