FPS is Introducing a New Facility for Law Firms That Need to Effect Service of Legal Documents in France

FPS, a French law firm specislizing in cross-border legal matters, has introduced an innovative facility which ensures that Court documents, summons, etc. are being served in a fast and efficient manner, by way of formal service, on litigants residing in France.

Paris, France, May 09, 2017 --(PR.com)-- Process serving, in France, of documents originating from abroad, such as Writs Summonses, subpoenas, etc., often is a blight by delays and communication issues.

It is essential to bear in mind that private agent service by a non-qualified professional may be quashed in the originating Court and any judgment obtained on the basis of service by a non-qualified person may be unenforceable, or may be voidable, because it is illegal under French law.

FPS has introduced a news facility, for foreign litigants and their lawyer / attorneys, which enables legal paperwork to be served in a fast and efficient manner.

There are 2 main methods for ensuring that legal paperwork issued abroad gets served on a Defendant in France. The 2 options are:

- Service through Central Authority;
- Direct service through local process server;

The Central Authority channel is time-consuming, since legal documents are processed through the Government's Administration. No option for expedited service exists. The Public Service channel is free of charge and has no taxes, but you must arrange for the paperwork to be translated into French, pay a Court bailiff's fees and any other disbursements, including Value Added Tax. The contents of your documents is inspected by a French State's representative for legality and conformity to internal laws and therefore your paperwork is not kept strictly confidential.

Direct service is preferable, because it is faster, usually less expensive (it does not requires translation as expressly allowed by Article 688.6 of the New Code of Civil Procedure), the documents are not being submitted to inspection by French Judicial authorities and are kept confidential.
