Data breach laws are different from state to state but both Kansas and Missouri require a business to respond to a known breach. It’s also important to note that even if a vendor causes a breach of your clients’ information, you are still responsible to respond to the breach notification laws.

“Aside from certain requirements under state and federal laws, it just makes good business sense for companies, no matter what their size, to establish and implement written data security policies in order to protect themselves and their customers from costly data security breaches,” said Tim Steffens, an attorney with Polsinelli Shugart who specializes in the space. In addition to a good breach response plan, businesses can purchase cyber liability insurance to help pay for the costs associated with a breach.
