About Michael N. Fine

Michael N. Fine is an attorney in the law firm of McDermott Will & Emery LLP and is based in the Chicago office. He is co-chair of the firm’s Tax-Exemption Affinity Group. His practice focuses on issues affecting tax-exempt health care organizations, including corporate governance, executive compensation, intermediate sanctions, joint ventures, charitable contributions and obtaining tax exemption from the IRS. Michael has experience representing tax-exempt organizations under IRS audit and advising them on captive insurance and other alternatives to commercial insurance.

Before joining McDermott, Michael was an attorney for an international law firm in Washington, D.C. There, Michael counseled individuals, corporations and partnerships on federal income tax issues, including planning and transactional matters, audit and controversy matters, and those involving tax-exempt organizations.

Michael has written numerous articles for Taxation of Exempts including articles on Section 501(r)’s requirements for tax-exempt hospitals, on FBAR filing obligations for Section 501(c)(3) entities and their directors and officers and on property tax exemption developments. He wrote the seminal article on tax exemption of qualified nonprofit health insurance issuers under Section 501(c)(29). He has also published articles with Captive Insurance Company Reports, Tax Analysts, Health Lawyers Weekly and frequently co-authors McDermott Will & Emery client alerts on topics that pertain to nonprofit and tax-exempt organizations

Section 501(r) of the Internal Revenue Code was enacted in March 2010 and mandates that nonprofit hospitals to comply with new requirements in order to maintain their tax-exempt status.
