Three Steps to Receiving Your Court Awarded Judgment

With a little hard work and determination, judgment owners can get the money awarded to them by the courts. It’s as easy as 1-locating the debtor, even if they’ve moved out of state; 2-finding the assets by searching public databases; and 3-seizing the assets and discharging the judgment.

Ms. Salim further states there are 3 basic steps to the judgment recovery process.

The first step is to locate the person. If you know where they live and/or work you can skip this step. However, if the person has moved and you don’t know where to find them, you will want to gain access to a skip tracing database. Ms. Salim relates that most people can be located through the paper trail created by daily activities.

Once you have up-to-date information on the whereabouts of the debtor you now need to determine if the debtor has any assets or has filed bankruptcy. This is step two. If the debtor has filed for bankruptcy your judgment may be wiped out by the bankruptcy. Looking for a bankruptcy case can be accomplished through the U.S. Court’s website or through a list service provider. List providers can also supply you with sources for locating the debtor’s assets.

After the assets have been identified, you’re ready for step 3 – file the appropriate forms to seize the assets and discharge the judgment. Within 30 to 90 days after processing the seizure, the court will release the monies or assets to you. At this point, if the amount recovered satisfies the entire amount of the judgment, notify the clerk of the court. Forms and procedures necessary for this step vary from state to state. Contact the clerk of the court in the county where the judgment was granted to obtain the correct information.
